Workplace Relations and Employment Law
At Marshalls & Dent we appreciate the confusion that our clients often face when dealing with workplace issues, both as an employer and employee. This arises from the complexity of the laws which govern workplace relationships which includes legislation, awards, various instruments such as AWA’s and enterprise agreement and of course, the contract of employment. Historically these laws have changed with much frequency.
Our job at Marshalls & Dent is to make life easier for our clients in working through workplace issues and also in assisting our clients to establish and maintain a healthy, organised and productive work environment. Where disputes arise in the workplace our job is to ensure the rights of our clients are best protected and pursued, whether that be for our employer clients or our employee clients.
Workplace issues which we are called upon to deal with include the following:
- Drafting and preparation and/or or review of employment contracts and subcontractor agreements;
- Advice on the effect of awards, legislation and other instruments on employment relationships;
- Unfair dismissal and constructive dismissal and/or wrongful termination
- Breaches of common law, contractual and statutory duties;
- Redundancy issues and the rights and obligations with respect to severance payments;
- Claims for harassment, discrimination, equal opportunity, bullying and unsafe and unhealthy workplaces;
- Human resource issues including workplace policies and practices;
- The effect of a transfer or sale of Business on employee rights and employer obligations;
- Occupational health and safety;
- Restraint of Trade and protection of confidential information and intellectual property.
